These Terms of Service ("Terms") govern your access to and use of Helperly (the "Service"), provided by Helperly ("we," "us," or "our") at helperly.app. By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
You must be at least 18 years old and able to form a binding contract to create a Helperly account. Helperly accounts are for parents, guardians, and organizations (such as studios and gyms) — not for children. If you invite a co-parent to your family, they must also meet these requirements to accept the invitation.
You're responsible for the accuracy of the information you provide, including activity schedules and any information you enter about your children, and for keeping your login credentials secure.
Helperly lets parents track kids' recurring activities on a shared calendar, with override-aware recurrence, email and push reminders, iCal export, and optional public schedule sharing. Organizations can create accounts to author and publish their own class schedules, which parents can follow.
We may add, change, or remove features at any time. We'll try to give notice of material changes that affect how you use the Service, but we don't guarantee any feature will remain available indefinitely.
Helperly offers free and paid plans for parents, and a paid plan for organizations. Paid plans are billed through Stripe on the cycle you select (monthly or annual) and renew automatically until canceled. Where a trial period is offered, it will be disclosed to you before you're charged.
You can cancel a subscription at any time from your billing settings; cancellation takes effect at the end of your current billing period unless we say otherwise. Except where required by law, fees already paid are non-refundable. We may change our pricing, but we'll give you notice before a change affects your then-current subscription.
You retain ownership of the information you submit to the Service — your account information, your kids' activity information, schedules you or your organization create, and anything else you provide ("Your Content"). By submitting Your Content, you grant us a license to host, store, process, and display it as necessary to provide the Service to you (for example, showing it on your calendar, expanding recurring events, sending your reminders, or displaying a schedule you've chosen to make public).
If you or an organization you administer uses the public schedule sharing feature, you're choosing to make that schedule's activity information visible to anyone with the link. You're responsible for deciding what to share publicly.
Your use of the Service is also governed by our Acceptable Use Policy, which is incorporated into these Terms by reference. Violating the Acceptable Use Policy is a violation of these Terms and may result in suspension or termination of your account.
Helperly and its original content, features, and design (excluding Your Content) are owned by Helperly and protected by applicable intellectual property laws. These Terms don't grant you any right to use our name, logo, or branding without our prior written permission.
You can delete your account at any time from your account settings. We may suspend or terminate your access to the Service if you violate these Terms or the Acceptable Use Policy, if we reasonably believe doing so is necessary to protect the Service or other users, or if required by law. Where practical, we'll try to give you notice first.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee the Service will be uninterrupted, error-free, or that reminders will always be delivered on time — Helperly is a scheduling aid, not a substitute for confirming activity details directly with your activity provider.
To the fullest extent permitted by law, Helperly and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the Service, even if we've been advised of the possibility of such damages. Our total liability for any claim arising out of these Terms or the Service will not exceed the amount you paid us in the twelve months before the claim arose, or $100 if you haven't paid us anything.
You agree to indemnify and hold Helperly harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, or your violation of these Terms.
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Kentucky, and you consent to personal jurisdiction there.
We may update these Terms from time to time. If we make a material change, we'll update the "Last updated" date above and, where appropriate, notify you directly. Continuing to use the Service after a change takes effect means you accept the updated Terms.
